Entity created to co-conspire with Commissioner Troy McDonald for the fraudulent "property auction mechanism" as an alleged settlement for City V Rudge IV. (Assoc Auction later dissolved 2025).
The City NEVER recorded this settlement in the 19th Circuit state court, wherein the City had obtained their unlawful ex parte TRO from Judge Metzger in 2009. The City's settlement offer "required" Rudge to auction his property (Associate Auctions) and the Rudge family would receive all proceeds after the City took $55,000. Transcripts even record the City attorney saying "We heard it was going for around two-hundred fifty thousand.." Associate Auctions, KC Daniel, auctioned off WJRIII's estate properties but did not keep his word to "auction" off the Rudge homestead. The Rudge family had already been removed by the city's bogus condemnation on March 5, 2009, used to justify the threat of ARMED FORCE BY A STATE POLICE AGENCY! The Rudge family received no proceeds as there was no auction. Fred Sundheim advised Assoc Auctions that there were "title issues" to prevent the auction.
Michael J. Mortell appointed City Attorney (2013-2023). Mortell was City of Stuart Mayor in 2010 and was major player in City V RudgeIV #09CA3586 Judge Metzger. Mortell met Metzger at NOVA SE and subsequently introuduced Metzger to her husband. Mortell was bested by Jim Christie in the 2012 Stuart City Commission race. Although Mortell could not garner enough votes to retain a commisssioner seat, Paul Nicoletti appointed Mortell as Attorney and Nicoletti became City Manager. A definitive example of "institutional capture".
Plaintiff AZ Properties practiced fraud, deceit, and trickery to obtain WJRIV's signature on deed, with AZ President Norman Zlinkoff telling him that the Rudge family would be getting no money from Plaintiff City for the City's violations of the family's consitutional rights saying "6 thousand dollars is better than nothin". The title to the Rudge property at 1701 SW Palm City Road was never legally conveyed to Plaintiff A to Z Properties (Zlinkoff, John Katsock Jr,Kilbride) for only $6,000! AZ's attorney, Mortell, KC Daniels and Stuart Commissioner Troy McDonald were ignorant of Florida law that "requires" both spouse's signatures "on the same page". Criminals don't always think through things! Follow the money $9.6M asset → $6K transaction. Alexzander Bonano, from the well known Gonano and Harrell, sent a letter to Defendant Rudge in July of 2016. Attorney Gonano writes that the deed his client, A to Z Properties, holds is "defective". Then Attorney Bonano asks WJRIV to sign a "curative deed", which WJRIV never signs. WJRIV has motioned 4 times for "Relief by a Declaratory Action" in the 19th Circuit, to "rescind the defective deed", beginning in August of 2019 to the latest of April 1, 2026. The Rudge family's homestead is protected under both ARTICLE VI, Section 7 and X, Section 4 of the FLORIDA CONSTITUTION). Even today, the illegally recorded deed has never been "corrected" by the Martin County Property Appraiser's office, the 19th Circuit Clerk's office or ANY of the judges involved in this litigation! How does this deed, which remains defective, go uncorrected for over a decade in the official record books in Martin County?? The answer is the "Fraud and Corruption" of judges, attorneys, clerks, City of Stuart Commissioners and police, etc...conspiring together, as public officials, to avoid accountability to the law!!
Michael Mortell claims settlement 'finalized' - ZERO documentary support in any jurisdiction. This claim used to deny Rudge constitutional hearings for next 16 years.

Every one of Mortell's pleadings, in defense of the City, were dishonest and divorced from the true facts. Mortell never presented any evidence to back his "perjurious pleadings" nor did any judge ever "fact-check" him! They are all besties! Go NOVA SE!

Michael Mortell was terminated as City Manager by the Commission and received a great severance package! Many Stuart residents shared the "harm" they had suffered from Mortell's misconduct as Attorney and Manager on camera at City Commission meetings! Because Mortell was not held accountable, he is now the Trial Court Administrator in the 19th Circuit! (further strengthening institutional capture!) Now Mortell has now been promoted so he can "work" with his co-conspirator NOVA SE friends: Judge Metzger and Judge Bauer. Mortell's ex-partner in a private firm, Lee Baggett, becomes City Attorney and is also NOVA SE grad! You could not make this shizz up!
Associate Auctions LLC dissolved AFTER being sued - entity used for 2015 FRAUDULENT property transfer, functionally divesting RudgeIV of ALL inherited properties from WJRIII in Martin county! In the City of Stuart's December 29,2010 "shade" meeting", the Commissioners were quoted 9 times, "conspiring to knock down the Rudge home" and keep the Rudge family off the property? This was after the City removed the family from their homestead on March 5, 2010 under the threat of armed force. In this meeting, both Attorney Nicoletti and Mayor Mortell mention the Rudge family leaving Florida. Mortell is even quoted, as Mayor, "they haven't paid anything to play in this thing?" Rudges believe "this thing" was Tibouchina Terrace! Mortell was involved from the get-go but he is not the head of the snake. This could not have transpired without the judges, whom were co-conspirators in the 19th Circuit, in and around Florida!
The Courts below, both state and federal, relied on Mortell's lack of candor with Court, incessant fraudulent conduct as a public official & an officer of the Court! Mortell as Mayor, Attorney, and Manager of the City resulted in ZERO constitutionally protected due process "evidentiary hearings or trials" for either Defendant WJRIV/CHYR in over a 16-year span. Mortell committed intrinsic fraud by perjuring himself in City's pleadings and committed a far worse violation by committing extrinsic fraud by keeping the Defendants AWAY FROM THE COURT by telling the Public and the Stuart City Commission that the case is "closed" and would not corroborate with CHYR to set hearings.
Carri Leininger is an "alleged" Board Certified Appellate attorney. She comes "out the gate" with an Answer for the City that is riddled with dishonesty, using the same "false narrative" as Mortell had for over a decade. WJRIV and CHYR were disgusted by this lack of honesty to a Federal court?
